By visiting Cooks Antiques & Collectibles, accessing our website, or engaging with our services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our services.
General Store Policies
Store Hours
Our regular business hours are:
- Mon, Tue, Thu, Fri, Sat: 10 AM – 5 PM
- Sunday: 10:30 AM – 5 PM
- Wednesday: Closed
Hours may vary during holidays. Please call ahead to confirm.
Purchases and Payments
- All sales are final unless otherwise stated
- We accept cash, credit cards, and debit cards
- Prices are subject to change without notice
- Items are sold as-is unless otherwise specified
Returns and Exchanges
Due to the nature of antique and collectible items, all sales are generally final. However, we will work with customers on a case-by-case basis for items that are significantly misrepresented. Please contact us within 48 hours of purchase to discuss any concerns.
Vendor Booth Rental Terms
Booth Rental Agreement
Vendors renting booth space at Cooks Antiques & Collectibles agree to the following terms:
- Booth rental fees are due monthly in advance
- Vendors are responsible for setting up, maintaining, and pricing their own merchandise
- All items must be clearly priced and tagged with vendor identification
- Vendors must provide appropriate sales tax documentation
- Booth rental agreements require 30 days notice for termination
- All vendor agreements are subject to these Terms & Conditions, which vendors acknowledge by entering into a booth rental agreement
Vendor Responsibilities
- Maintain booth in clean and organized condition
- Ensure all items are safe and in good condition
- Comply with all applicable laws and regulations
- Provide accurate descriptions and pricing for all items
- Remove unsold items promptly upon termination of rental agreement
Prohibited Items
Vendors may not sell:
- Illegal items or counterfeit goods
- Weapons or ammunition (unless antique and non-functional)
- Hazardous materials
- Items that violate intellectual property rights
Commission and Fees
Cooks Antiques & Collectibles retains a commission on all sales made through vendor booths. Specific commission rates and fee structures are outlined in individual vendor agreements. Contact us for current rates and availability.
Photography, Marketing, and Vendor Content Rights
Store Photography and Recording
Cooks Antiques & Collectibles reserves the right to photograph and record images or video within the store premises, including vendor booths, displays, and merchandise, for marketing, promotional, website, and social media purposes.
Ownership and Use of Images
Photographs and videos taken within the premises are the property of Cooks Antiques & Collectibles and may be used without additional permission or compensation, provided the images are used to promote the store or its operations. By displaying merchandise on the premises, vendors acknowledge and agree that their items, booths, and displays may appear in such photos or videos.
Marketing Materials and Vendor Approval
Vendors do not retain approval rights over marketing materials that include their items when photographed within the store. While Cooks Antiques & Collectibles will make reasonable efforts to remove specific images upon request, the store is not obligated to do so, especially after a vendor relationship has ended.
Vendor Relationship Termination
Upon termination of a vendor relationship, Cooks Antiques & Collectibles retains the right to continue using previously created marketing materials that include vendor items or booth displays.
No Implied Endorsement
Inclusion of vendor items in marketing materials does not imply endorsement of any individual vendor or products. Marketing materials are created to promote the store as a whole and the shopping experience available to customers.
Safety and Store Operations Priority
Cooks Antiques & Collectibles reserves the right to temporarily move or remove items for safety, maintenance, or operational reasons without prior notice to vendors.
Conduct and Harassment Policy
Abusive, threatening, or disruptive behavior toward staff, customers, or other vendors is strictly prohibited and may result in immediate termination of vendor agreements without refund of rental fees. Cooks Antiques & Collectibles is committed to maintaining a respectful and professional environment for all.
Liability and Disclaimers
Limitation of Liability
Cooks Antiques & Collectibles is not responsible for:
- Loss, theft, or damage to vendor merchandise
- Personal injury or property damage while on premises (except as required by law)
- Accuracy of item descriptions provided by vendors
- Authenticity of items sold by vendors
Indemnification
Vendors agree to indemnify and hold harmless Cooks Antiques & Collectibles from any claims, damages, or expenses arising from their merchandise or conduct.
Intellectual Property
All content on our website, including text, images, logos, and design elements, is the property of Cooks Antiques & Collectibles or its content suppliers and is protected by copyright and trademark laws.
Changes to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services constitutes acceptance of any changes.
Governing Law
These Terms of Service are governed by the laws of the State of Tennessee, without regard to its conflict of law provisions.
